Terms of Service

1. Services

Smart Move Marketing provides digital marketing services including but not limited to SEO, web development, paid advertising management, social media management, content marketing, branding, AI search optimization, and analytics consulting. The specific scope of work for each engagement is outlined in individual proposals and agreements.

2. Engagement Terms

All engagements operate on a rolling monthly basis unless otherwise specified in writing. We do not require long term contracts. Either party may terminate the engagement with 30 days written notice.

3. Payment Terms

Invoices are issued at the beginning of each service period and are due within 14 days of receipt. Ad spend budgets are billed separately from management fees and are paid directly to the advertising platforms.

4. Intellectual Property

All custom work produced for clients (websites, designs, content, campaigns) becomes the property of the client upon full payment. We retain the right to showcase work in our portfolio unless otherwise agreed in writing.

5. Account Ownership

All advertising accounts, analytics accounts, and third party platform accounts created or managed on behalf of clients remain the property of the client at all times. We will never hold accounts hostage or restrict access.

6. Confidentiality

We treat all client business information, strategies, and data as strictly confidential. We will not share your information with third parties except as required to deliver our services (e.g., ad platform APIs) or as required by law.

7. Limitation of Liability

While we strive to deliver the best possible results, we cannot guarantee specific outcomes such as search rankings, traffic levels, or revenue figures. Digital marketing results are influenced by many external factors beyond our control. Our liability is limited to the fees paid for the services in question.

8. Website Use

Statistics and data referenced on this website are sourced from third party research and are believed to be accurate at the time of publication.

9. Governing Law

These terms are governed by the laws of Australia. Any disputes arising from these terms will be resolved in the courts of Australia.
